IPRs are always related to know-how, trade secrets or proprietary information &#8211; they tend to move in clusters.</span></span></p>

<p style="text-align: justify;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">Each has real and verifiable value, and each will vary considerably from company to company. </span></span></p>
<p style="text-align: justify;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">In some businesses, the marketing group will clearly be dominant while in others, the technical group,<br />
or the knowledge or skills group may carry the weight of value.</span></span></p>

<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">for the clients and consumers – how they appreciate / view the company’s intangible assets in relation to its products / service</span></span></li>
<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">for the competitors &#8211; are they trying to copy/use the company’s intangible assets</span></span></li>
<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">for potential users of these intangible assets – are they interested in using/acquiring the company’s IPR for their own business development</span></span></li>
</ul>

</ul>
<p style="text-align: justify;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">All aspects should be reflected in the assessment and valuation of the company’s intangibles and on this basis the strategic decision to be made – what to do with these intangible / IPR assets.</span></span></p>
<ul style="text-align: justify;">
<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">Examples that the process of identifying and using intangible assets effectively can be seen everywhere. </span></span></li>
</ul>
<p style="text-align: justify;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">One impressive example is IBM.</span></span></p>
<p style="text-align: justify;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">In the late 1990s IBM undertook a comprehensive audit of its intellectual property assets to find that many research results were protected by patents or other IPRs, but these were largely underused by the company. </span></span></p>
<p style="text-align: justify;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">Income from licensing and royalties (generally from technology): around 30-40 Million US$ annually. </span></span></p>
<p style="text-align: justify;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">Following the IP audit exercise and a subsequent review of internal policies and management practices, IBM’s annual revenue from licenses and royalties jumped in the early 2000s to over 1.7 Billon US$. </span></span></p>
<h5 style="text-align: justify;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US"><b>Protect the assets</b></span></span></h5>
<ul style="text-align: justify;">
<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">Assessment and valuation of IP assets will facilitate their protection, and establishing an IP policy of the company </span></span></li>
<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">Not all intangible assets can be protected as IPRs and therefore special provisions have to be made to ensure protection against unsolicited disclosure and illegal use</span></span></li>
<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">Clear procedures should be established for the protectable IPRs (inventions, designs, trademarks, etc.) concerning the different decisions to be taken by management in line with the business objectives and applicable legislation: e.g., invention disclosure procedures, for which IPRs and when to start the procedures, where, in respect of which markets, periodical review of IPR titles and their maintenance, etc.</span></span></li>
<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">Special attention should be given to the protection of trade secrets and know-how. These are very often in the core of the company’s manufacturing and service activities. And leaking trade secrets and proprietary information can result in considerable, even irreparable damages to the core business of the company.</span></span></li>
<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">In this context attention must be given to sensibilization of staff and consultants to keeping secret company’s trade secrets, know-how and proprietary information </span></span></li>
<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">Since IPR protection has costs a clear and long term decision on the protection and use of IPRs should obligatory be accompanied by proper financial commitments</span></span></li>
<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">Medium and long term protection of IPRs and their use (internally or externally (e.g. licensing)) should be subject of periodic reviews and assessment – at least once a year. </span></span></li>
</ul>
<h5 style="text-align: justify;"><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US"><b>Use the assets to create value, gain competitive advantage</b></span></span></h5>
<ul>
<li style="text-align: justify;"><span style="font-size: 12pt; font-family: verdana, geneva, sans-serif;"><span lang="en-US">Identified, categorized, valued and protected IP assets </span><span lang="en-US">are</span><span lang="en-US"> pre condition / sound basis for decisions on how to better exploit IPRs through use and/or commercialization. </span></span></li>
<li><span style="font-family: verdana, geneva, sans-serif; font-size: 12pt;"><span lang="en-US">Good IP governance will provide the business with numerous commercial and bottom-line benefits (see Annex II) including improved:</span></span>

<li style="text-align: justify;"><span style="font-size: 12pt; font-family: verdana, geneva, sans-serif;"> <span lang="en-US">accountability of resources; </span></span></li>

Иванов е водещ български експерт в областта на интелектуалната собственост, с активна обществена дейност в подкрепа на националната интелектуална собственост; преди 14 години с участието на eнтусиасти създава <a href="http://ipbulgaria.bg.bg" target="_blank" rel="noopener noreferrer">IPBulgaria.bg</a>, с негово участие и подкрепа портала се превръща в средище за IP дискусии и информация; основател и представител по индустриална собственост в консултанската агенция за интелектуална собственост <a href="http://ipconsulting.eu" target="_blank" rel="noopener noreferrer">IPConsulting.eu</a> </em></p>
<h3 style="text-align: justify">Г-н Иванов тази година Световната организация за интелектуална собственост WIPO обяви за мото на световния ден на интелектуалната собственост  „ Get up, stand up. For music ”, за Вас това мото какво означава?</h3>
<p style="text-align: justify">“Събуди се. Стани за Музиката” е едновременно много сложно мото, но и близко до нормалното ни ежедневие, описващо начина ни на живот и съществуване. Музиката е в нас и ние имаме нужда от нея, а тя “музиката” &#8211; творбата, има нужда от нас. Това е мото, което зове за пробуждане и ни вдъхновява да застанем, всеки както може, както го разбира, зад музиката, в защита на<img decoding="async" class="alignright wp-image-13411 size-medium" src="https://ipbulgaria.bg/wp-content/uploads/2015/04/ivan_music-240x174.jpg" alt="интелектуална собственост" width="240" height="174" /> &#8222;своята музика”. Впечатлявам се от изразността на това мото, в което има толкова много съдържание, емоции и действие, и което в същото време е толкова кратко. С много малко думи, както само истинските творци го могат, се изпълва огромно съдържание и обединява, мислено и емоционално милиони. Милиони хора по целия свят изпълняват, създават и се вълнуват от музика. Милиони творци могат да нарекат своите произведения музика, могат да свържат своите произведения с музика, или са създали произведенията си докато са слушали, изпълнявали или мислили за определена музика.</p>
<p style="text-align: justify">Събуждането, пробуждането е необходимост, призив, очертаващ едновременно проблема, че си затваряме очите и сетивата и в същото време събуждането е едно красиво начало, момент, в който можеш всичко &#8211; ти решаваш как да започне &#8222;новия ти ден”.</p>
<h3 style="text-align: justify">Бихте ли свързали мотото на този световен ден с България и как то Ви звучи през погледа у нас?</h3>
<p style="text-align: justify">Ние в България не сме на безлюден остров &#8211; тенденциите в света и у нас са едни и същи. Обмена на стоки и услуги, движението на хора и информация е толкова бързо, че възникващите творби, иновации и нововъведения се разпространяват понякога дори мигновенно, а с тях и съпътстващите ги проблеми и конкуренция за извличане на максимална полза.  На полето на интелектуалната собственост, наличието на конкуренция е реален фактор и ако не сме събудени, няма да чуем музиката, която се свири, най-образно казано. Ние в България не винаги добре разбираме, че не само заобикалянето на съществуващите права е лесния начин на съществуване; че ограничаването на чуждите права ще ни донесе успех. Имам чувството, че нямаме достатъчното самочувствие, че можем да използваме правата на интелектуална собственост в наша полза и да извличаме максималната изгода за себе си използвайки създадените правила. Сама по себе си системата за интелектуална собственост е създадена, за да носи със себе си ползата за творците и тези които са инвестирали в тях.</p>
<h3 style="text-align: justify">Казвате, че според Вас системата за защита на авторски права и интелектуална собственост носи ползи, но в България не всички са убедени в това.</h3>
<p style="text-align: justify">Да, при нас основния проблем е в разбирането и проблема се задълбочава от това, че по темата не се говори или поне не се говори достатъчно.  Ето например в днешния ден &#8211; световен ден на интелектуалната собственост &#8211; държавната администрация е в почивка &#8211; днес е неделя &#8211; те не са се събудили, не са станали и не призовават никой да застане в подкрепа на музиката. Личният пример е заразителен &#8211; днес единствено IPBulgaria.bg ще разпространи празничното си послание &#8211; на страниците на портала и сайта за авторско право CopyRights.bg,  чрез бюлетина си и в социалните мрежи; Утре и Университет по библиотекознание и информационни технологии ще проведе семинар на тема “Интелектуалната собственост – формула за успех, творчество и иновации”, а държавната администрация отново ще проспи и този ден.</p>
<h3 style="text-align: justify">С промяна в поведението на държавната администрация ли според вас трябва да се започне?</h3>
<p style="text-align: justify">Националната политика според законите на държавата се води от нейната администрация в областта на интелектуалната собственост. В света има консенсус по темата интелектуална собственост &#8211; това е тема, която изисква най-високото държавно участие и за това в рамките на ООН е създадена Световната организация за интелектуална собственост &#8211; там се дискутират всички въпроси, координират се и се създават международни споразумения и договори. В България години след този световен консенсус ние не сме започнали дори дискусията, за това че ни е необходим единен държавен орган за интелектуална собственост &#8211; България няма единна администрация, комисия или съвет по интелектуална собственост. Днес индустриалните права се регистрират в Патентно ведомство, което по скоро е ведомство за търговски марки (патентните заявки са минимален брой), необходимо е поне името на това ведомство да съответства на функциите му. Съществува дирекция авторско право в Министрество на културата, на която са възложени и функциите на регулатор в областта на авторското право &#8211; странно припокриване на компетенции и отговорности в контекста на принципа на конфликта на интереси &#8211; Министерство на културата е ползвател на авторски права, в същото време и регулатор и административно-наказващ орган. Не докрай изяснени остават функциите на ИАСАС и Министъра на Земеделието в защитата на новите сортове растения и породи животни и субординацията им с Патентното ведомство.</p>
<h3 style="text-align: justify">Вие говорите за необходимостта от създаване на Ведомство за интелектуална собственост, по примера на много други държави в света ли?</h3>
<p style="text-align: justify">Да, именно новия прочит на тенденциите в областта на интелектуалната собственост, членството ни в Европейския съюз и максималната полза, която трябва да се извлече за българските творци, индустрия и инвеститори в страната ни изискват обединяване капацитета на администрацията  в национално ведомство по интелектуална собственост. Обединения капацитет на администрацията ще позволи предоставянето на навременни конкурентни информационни услуги за творците, изобрететелите и инвеститорите; разгръщането на цялостна информационна среда, реална оценка, финансова подкрепа и пазар на IP обекти и достъпност на системата за българските лица, без да се създават преференции за чуждите заявители и ползватели.</p>

Стани за Музиката” нека не пропускаме утрото, събуждайки се за новостите, нека слушаме музика, нека слушаме българска музика &#8211; Радо Михов е един добър пример за това, нека се заслушаме в музиката на творбите на българските автори &#8211; Вероника Денева написа за нас „Един друг живот”, „Сценарий за бъдеще” и „Живот на паралел”; музиката е вдъхновение и необходимост за танците, които ни пресъздава Зорица Радловска, за фотографиите на Росен Александров, за Митко Цонев и за всички нас.</p>
